TERMS AND CONDITIONS
These terms and conditions, set out the agreement (the “Agreement”) between you (the “Customer”) and N6 (Concession) Ltd (“N6”) in relation
to the supply/ purchase and the use of prepaid trip cards issued by N6 (“Trip Cards”) on the M6 toll road.
N6 may alter, amend, or otherwise change the terms and conditions of this Agreement at any time by providing notice on the company website, www.n6concession.com (the “Company Website”).
N6 do not charge an administration fee for the supply of these Trip Cards.
The Trip card will allow for passage of the registered vehicle on the M6 motorway at a 10% discounted rate per journey once journeys are pre- paid in multiples of 20 journeys chargeable at the applicable fares at the time of the purchase.
1. PURCHASING A TRIP CARD
The Trip Cards can be purchased at the N6 toll plaza in Cappataggle, Ballinasloe Co. Galway or by contacting the N6 Office (091 843500) during office hours. This is typically between the hours of 9am and 4pm daily. Details of the vehicle that you wish to register, vehicle class must be given and payment will be made for a minimum of 20 trips for the particular vehicle class. A copy of this Agreement is available on the company website, subject to change by N6 from time to time. New Trip Cars can be collected at the N6 Toll Plaza Lane subject to prior agreement with the N6 Office.
Each trip card is valid only for five years from first purchased or for five years from the last time the card was “topped up”.
2. ACCEPTANCE OF THIS AGREEMENT
2.1 Once payment is accepted and processed, the Trip Card will be activated, and you will then be deemed to have entered into this Agreement and to have accepted the terms and conditions of purchase and use.
3. TOLLS
3.1 Without affecting any legal obligation imposed on you by applicable law, you are liable to pay to N6 each and every toll that may be incurred by you pursuant to applicable law and such amounts shall be discharged in accordance with this Agreement.
3.2 The Tolls applicable to M6 toll road may be adjusted from time to time in accordance with the applicable law.
3.3 The Trip card is for use exclusively on the M6 motorway at the toll plaza, Cappataggle, Ballinasloe. Co. Galway and cannot be used as payment on any other toll road.
4. TRIP CARDS
4.1 A Trip Card may only be used for the same class of vehicle which it has been purchased for.
4.2 New Trip Cards can only be purchased at the N6 toll plaza in Cappataggle, Ballinasloe Co. Galway or by contacting the N6 Office (091 843500) during office hours. This is typically between the hours of 9am and 4pm daily at the N6 Toll Plaza, Cappataggle, Ballinasloe Co Galway. You can “Top-up” (purchase additional trips in multiples of 20) at the lanes or on line from the Company Website.
4.3 Payment of a toll by use of a Trip Card can only be accepted by the presentation of a valid Trip Card with prepaid trips outstanding.
4.4 Where you have breached this Agreement (by reason of failing to pre-pay any amount due to it in accordance with this Agreement), N6 must treat you as if the vehicle are not the owner of a Trip Card in which case you shall be liable to pay tolls at the full toll amount (for clarity this means without the discount of 10%) and at the rate applicable at the time of the transit.
4.5 Trip cards can be used on manual and semi-automatic lanes only. In manual lanes, the operator can issue a “Remaining Trips Balance Note” if requested which will indicate the number of remaining trips on the card. In semi-automatic lanes, you can request a “Remaining Trips Balance Note” by pressing the receipt button, which will also indicate the number of Trips remaining on your card.
4.6 A receipt is issued when you purchase a trip card or top-up a trip card. The receipt will be dated, showing the value of the purchase, the vehicle class and N6 details including the N6 VAT registration number.
5. SUPPLY AND USE OF A TRIP CARD
5.1 Once you have purchased a Trip Card N6 shall provide you with the Trip Card (or Trip Cards) and you shall:
- (a) carry and use the Trip Card exclusively for the registered class of vehicle for which the Trip Card is issued;
- (b) only use the Trip Card in accordance with this Agreement for the same vehicle class in respect of which the Trip Card wasissued;
- (c) not transfer, sell, dispose of, damage or tamper with the Trip Card or use the Trip Card fraudulently or illegally;
5.2 In the event that N6 is of the opinion that the Trip Card is or has been subject to misuse, N6 will be entitled to cancel or otherwise disable the Trip Card so that no further use may be made of the Trip Card for the purposes of discharging tolls. N6 shall not be liable to you for any cancellation of the Trip Card due to any actual or reasonably suspected misuse of the Trip Card.
6. DAMAGED / LOST / STOLEN TRIP CARDS
6.1 N6 shall not be liable to you in the event that a Trip Card is damaged, lost or stolen.
6.2 For the purposes of this Agreement, damage is defined as the rendering of the Trip Card defective or inoperable due to abuse, improper use, defacement, or accidental destruction.
6.3 Trips are not redeemable for lost, damaged or stolen Trip Cards.
7. TERMINATION
7.1 This Agreement may be terminated by N6 with immediate effect where you fail to use the Trip Card in accordance with this Agreement or you have made or purported to make use of the Trip Card in an unauthorised or unlawful manner.
8. AMENDMENTS TO AGREEMENT
8.1 The terms and conditions of this Agreement may be changed by N6 at any time and any such changes will be published on the N6 website 30 days prior to coming into effect.
9. REPRESENTATION AND WARRANTY
You represent and warrant to N6 that;
- (a) the information disclosed to N6 in connection with this Agreement is true and correct;
- (b) you have validly accepted this Agreement; and
- (c) this Agreement constitutes your valid and binding obligations.
10. LIABILITY
10.1 Neither N6 nor its agents will have any obligation or liability with respect to your use or the performance of the Trip Card.
10.2 Without prejudice to the foregoing, N6 shall not be liable to you for any loss of profits, goodwill, business opportunity or any type of special, indirect or consequential loss incurred by you, whether directly or indirectly.
11. PRICING
11.1 Trips can only be purchased in prepaid blocks of 20 Trips chargeable at the rates applicable at the time of the purchase.
11.2 The 10% discount is applied only to prepaid purchases of 20 Trips chargeable at the rates applicable at the time of the purchase.
11.3 Toll Charges will be reviewed at a minimum of once a year (end of calendar year) and/or from time to time as required by legislation. Remaining trip balance on a card at the time of review will be used to calculate the new trip balance based on any price changes.
12. NOTICES
Where either you or N6 is required to notify the other pursuant to this Agreement, or otherwise wishes to communicate with the other, such notice or communication may be served:
- (a) in your case to N6
- (i) by posting to: N6 (Concession) Ltd, Toll Plaza Building, Cappataggle, Ballinasloe, Co. Galway, Ireland; or
- (ii) by email at: info@n6concession.com
- (b) in the case of N6 to you, by publication on the Company Website.
